Welcome to Sideye!
Sideye is a mobile application that allows users to analyze the public activity of a specific Instagram account, including followers, following, and visible changes.
The purpose is to help users better track the public activity of a person on Instagram.
These Terms of Use (hereafter “TOU”) define the conditions under which the User is authorized to use the Application and benefit from its Services.
By using the Application, you fully and unreservedly accept these TOU.
Our Privacy Policy is an integral part of these TOU.
1. Definitions
- “User”: any natural person using the Application and its Services.
- “Application”: the mobile application Sideye, available on iOS and Android.
- “Services”: all features offered by Sideye to analyze the public activity of a specific Instagram account (followers, following, visible changes).
- “Parties”: refers to Sideye and the User.
2. Access to the Service
Access to Sideye requires providing a valid public Instagram username to monitor.
No private data or personal messages are collected: only followers, following, and publicly available information are processed.
A unique anonymous device identifier is used to associate your monitored account with your device. You are responsible for maintaining the security of your device.
In case of fraudulent use, you must immediately contact: contact@sideye.app.
3. Age Restriction and Parental Consent
Sideye is intended only for users aged 13 and above. For users between 13 and 16, parental consent may be required depending on your country of residence.
4. Subscription and Payment
Use of Sideye requires a paid subscription via the Apple App Store or Google Play Store.
- The price, duration, and terms of the subscription are displayed in the Application at the time of subscription.
- Payments are processed by Apple or Google through their in-app billing systems.
- The subscription is set to automatically renew unless canceled through your Apple or Google account at least 24 hours before the end of the current period.
- Sideye does not provide direct refunds: any refund request must be submitted to Apple or Google, in accordance with their terms.
5. Description of Services
Sideye offers the following features:
- Analysis of followers and following of a monitored Instagram account.
- Monitoring the evolution of a person's followers and following lists.
- Viewing activity changes and new follows/unfollows.
- Access to statistics and insights related to this activity.
- Push notifications about detected activity changes.
The Application has no official affiliation with Instagram, and its functioning depends on the availability and changes of that platform.
6. Use of the Application
The User agrees to use Sideye in accordance with these TOU and applicable laws.
It is strictly forbidden to:
- Use the Application to harass, intimidate, or harm others.
- Use the information obtained for illegal or discriminatory purposes.
- Attempt to bypass the Application's security measures.
- Collect data for commercial resale or unauthorized marketing.
- Attempt to monitor private Instagram accounts.
Sideye reserves the right to suspend or terminate any access in case of non-compliance with these obligations.
7. Account Deletion
The User may request the deletion of their data at any time via contact@sideye.app.
Sideye may also suspend or terminate access in case of TOU violation or security concerns.
8. Intellectual Property
Except for publicly available Instagram content, the Application and all its components (code, design, databases, branding) are the exclusive property of Sideye. Any reproduction, extraction, or unauthorized use is prohibited and may lead to legal action.
9. Disclaimer of Warranty and Liability
Sideye is provided “as is”.
We do not guarantee:
- The absence of interruptions or errors.
- Permanent compatibility with Instagram (technical changes, API updates).
- The accuracy, completeness, or timeliness of displayed data.
- Continuous availability of the service.
Our liability is limited to direct material losses. We are not responsible for indirect damages (loss of opportunity, time, etc.).
10. Data Protection
The rules regarding the collection and processing of data are detailed in our Privacy Policy.
11. Changes to TOU
Sideye reserves the right to modify these TOU at any time. New conditions will be published in the Application and must be accepted upon first use after the update.
12. Governing Law and Jurisdiction
These TOU are governed by the laws of the State of Wyoming, United States. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of Wyoming, United States.
